I gave the caterer a check for deposit to hold Sept. 9 for our reception. We aren't able to get married on that date so I called the caterer and advised him we have to move wedding to 10months later and we would like our deposit check back.

He then told me we couldn't have it back even though he hasn't deposited it yet. I told him it wasn't right to hold a check for 10 months and since I'm giving him a two month notice that we wont be able to get married in Sept we should get check back.

He refused. We cancelled the check and now he's sending us a threatening letter that its against the law and he will send a constable to our house to collect the money.

Is he correct that it's against the law to cancel a check even if services ARENT rendered?

We are not lawyers so the first thing I would do is to read my contract. It should make mention of deposits.
